The state of Florida understands the important role that grandparents play in the lives of their grandchildren. However, during the divorce of the children’s parents, grandparents may find it more challenging to maintain a relationship with them.
According to Florida law, however, grandparents may have the legal right to visit with their grandkids.
Petitioning for Visitation
Biological grandparents have the right to petition for visitation with their grandchildren, even if the children are not living with their biological parents. To do this, grandparents must fill out paperwork at the county courthouse where the grandchildren reside. This paperwork should demonstrate the bond between the grandparents and the children and provide evidence that visitation would be beneficial.
Supporting Visitation Rights
Courts are more likely to grant visitation to grandparents who can prove that they have a strong relationship with their grandchildren and that cutting off contact would harm the children. Showing a willingness to foster a positive relationship between the children and their custodial parents also increases the chances of obtaining visitation rights.
Visiting With Grandchildren
In many cases, grandparents can arrange visits with their grandchildren in their own homes. Typically, a social worker will help work out dates and times for the kids to visit with their grandparents. During these visits, grandparents can give gifts and cards to their grandchildren, who have the right to receive them.
Keep in mind that visitation is not necessarily permanent, and courts can modify or terminate visitation if the grandparents violate any stipulations set down by the court.
